Terms and conditions

General

1. By entering the Promotion, entrants agree to be bound by these Terms & Conditions (“Terms”).

2. The promoter is Bosch Thermotechnology Limited, a company incorporated in England and Wales with company number 01993294, whose registered office address is Cotswold Way, Warndon, Worcester, WR4 9SW, United Kingdom (“Promoter”).

3. The Promotion will commence on 10:00 (GMT) on Monday 5^th July 2021. The closing date for receipt of Entries is 23:59pm (GMT) on Friday 13^th August 2021 (“Closing Date”).

4. The Promotion is open to gas safe registered installers based in the United Kingdom aged 18 or over. Employees of the Promoter, or of any other company within the Bosch group of companies (including BSH Home Appliances Limited), and their immediate family members, Bosch’s agents or their employees, or any person professionally associated with this Promotion (or members of their family or household) are excluded from participating (“Eligible Participant”).

5. The Promoter assumes that by entering the Promotion (and the Participant warrants that) the Participant is aged 18 or over. Participants entering the Promotion as an employee of an organisation have an obligation to (i) inform their employer about the Promotion, and (ii) obtain the permission of their employer to enter the Promotion.

The Entry

6. An Eligible Participant will automatically be entered into the Promotion if they, before the Closing Date:

a.Post a picture of a Worcester Bosch Greenstar 4000 boiler installation they have completed to their personal or business Instagram feed, complying with the requirements of these Terms, in particular Clause 7 (the “Post”); and

b. tag the Promoter’s professional Instagram channel @WorcesterBoschProfessional in the Post; and

c. add ‘#WorcesterBosch’ to the Post; and

d. follow the Promoter’s Instagram profile at https://www.instagram.com/worcesterboschprofessional,

(together the “Entry”).

7. The Post must include a picture which must:

a. not be older than three (3) months; and

b. show a correct and legally compliant installation of a Worcester Bosch Greenstar 4000 boiler; and

c. show the boiler in its entirety (“Picture”).  

8. Multiple Entries can be made per Eligible Participant, however each Entry must be a separate Instagram post. The participant warrants that the Picture shows their own installation. Pictures of installations by other installers are not accepted.

9. It is the sole responsibility of the participant to ensure that the Picture complies with any data protection legislation, does not include any personal data, does not show anything else other than the installed boiler and in particular does not allow any inference or conclusion to be made about the homeowner or the homeowner’s address or identity. The Promoter reserves the right to require the removal of any Post that does not comply with the provisions of this clause.

10. Each Entry will be assessed by the Promoter’s technical support team who will approve it provided that:

a. it complies with the requirements of these Terms; and

b. the Picture shows that the boiler was installed correctly

(the “Approved Entry”).

11. Any Entry that does not contain the information required pursuant to these Terms will be an invalid Entry and will not be entered into the Promotion. The Promoter reserves the right and has complete discretion to disqualify any Entry deemed unsuitable, inappropriate, explicit or offensive, and accepts no responsibility for Entries not successfully or fully completed due to any reason including technical faults. Disqualified entrants will not be informed.

12. Entries received after the Closing Date will not be accepted.

13. By participating in the Promotion, subject to Clause 34, all entrants give their consent for the Promoter to use their Picture for ongoing marketing purposes, including being shared on Worcester Bosch social media pages, in the press, and on the Worcester Bosch website.

The Entry into the Promotion

14. Within seven (7) days of the Closing Date, the Promoter’s Technical Support Team will choose the ten (10) best Approved Entries, based on the quality of the installation, including workmanship and cleanliness of the work area.

15. The best ten (10) Approved Entries will be reposted on the Promoter’s professional Instagram feed [https://www.instagram.com/worcesterboschprofessional] with a number against their Picture (the “Reposting”). Subject to Clause 34, all entrants give their consent for the Promoter to Re-post their Picture.

16. During a period of seventy-two (72) hours from the date and time of Reposting (“Reposting Period”), all visitors to the Promoter’s professional Instagram page may vote for their favourite Reposted Picture by commenting with the number of their favourite Picture.  

17. The Reposted Picture that receives the most votes (via visitor comments) shall be the winner of the Promotion (“Winner”). In the event there is more than one Picture with the highest number of votes (i.e. if there is a tie), the Winner will be chosen from those with the highest number of votes via a random draw conducted by the Promoter.

The Prize

18. The prize shall be one (1) Greenstar 4000 boiler (“Prize”).

19. There will be one (1) Prize in total that will be awarded to one (1) individual Eligible Participant.

20. The Promoter will identify and notify the Winner within a period of seven (7) days from the end of the Reposting Period. The Winner gives their consent to be notified by a post on Instagram by the Promoter and to be sent an Instagram message from the Promoter (“Notification”).

21. The Winner must contact the Promoter within fourteen (14) days of the date of the Notification to claim the Prize and provide the Promoter with their email address, telephone number and delivery address, and confirm which Greenstar 4000 model they would like from a range made available by the Promoter in its sole and absolute discretion (“Winner Confirmation”). If the Winner fails to claim the Prize within the specified period, the Winner will forfeit the Prize, and the Picture with the next highest number of comments received in the Reposting Period will be chosen as the Winner.

22. The Promoter will arrange for the Prize to be delivered to the Winner’s address in the United Kingdom at the Promoter’s cost. Please allow up to twenty-eight (28) days from the Winner Confirmation for delivery of the Prize.

23. The Prize does not include any accessories and installation which must be arranged for and purchased by the Winner at their own cost. The Winner must ensure the Prize is professionally installed by a Gas Safe registered installer in compliance with the manufacturer’s requirements and applicable laws and regulations. The Winner is free to choose an installer of their choice.

Other important information

24. The Prize is not transferable and there is no cash alternative. The Promoter reserves the right to substitute the prize with product(s) of equal or greater value at any time.

25. In all matters relating to the Promotion, the decision of the Promoter shall be final and no correspondence or discussion shall be entered into.

26. At all times throughout the Promotion, participants must deal with the Promoter in the utmost good faith in every respect. The Promoter reserves the right to verify the eligibility of all participants and disqualify any participant that it has reasonable grounds to believe has breached any of the Terms, including, but not limited to, falsifying any information submitted to or requested by the Promoter.

27. The Promoter reserves the right to amend or terminate the Promotion at any time without notice. However, the Promoter will use its reasonable endeavours to minimise the effect of such amendment or termination to avoid disappointment. Any termination or amendment to the Promotion will be communicated in the same way as the Promotion was communicated.

28. The Promotion cannot be used in conjunction with any other promotions that are run by the Promoter or any company within the Bosch group of companies.

29. The Promoter excludes all liability for taxes relating to Prize(s) and any tax liability arising from the provision of the Prize(s) will be the sole responsibility of the recipient of the Prize(s).

30. The Promoter does not claim any rights of ownership in your Entry, nor does the Promoter accept responsibility for the return of any Entry, including those consisting of artistic or other material.

31. The Winner name can be obtained by sending a stamped addressed envelope to: Bosch Thermotechnology Ltd., Cotswold Way, Warndon, Worcester, WR4 9SW United Kingdom.

32. The Promotion is not affiliated with Instagram and is in no way connected with, sponsored or otherwise supported, accompanied or monitored by Instagram or any subsidiary companies and/or associates. All questions, comments or complaints relating to the Promotion should be addressed to the Promoter and not to Instagram.

33. If a Participant does not wish for their details or Entry to be entered into the Promotion or if they opt out, or wish to re-enter, they can advise the Promoter by writing to its address set out in clause 2, or by email to: Marketing.Wo@uk.bosch.com.

34. The Promoter will process the participants’ personal data on the Promoter’s behalf for the purposes of the Promotion and complying with its delivery commitments. The Promoter’s legal basis for processing the personal data is that the processing is carried out for the legitimate business interests in connection with the Promotion and, if applicable, supply of the chosen products. The Promoter will not process the participants’ personal data for other purposes unless they have a legal basis for doing so. The Promoter handles the participants’ personal information in a secure and confidential manner and always in accordance with the law, including the General Data Protection Regulation (2016) and applicable UK law. It will not disclose the participants’ personal information to third parties unless there is a legal basis for this. The law provides the participants with rights in relation to their personal information. 35. The Promotion will be governed by the laws of England and Wales and the courts of England and Wales shall have the exclusive jurisdiction to settle any dispute or claim arising out of or in connection with the Promotion.
